Terms of Service

By using Honk, you're agreeing to a few things. The big ones: use the app legally, don't try to break it, your data stays yours, and if something goes wrong, here's how we handle it — fairly, and in plain English.

1. Who you're agreeing with

You're entering into this agreement with Dispatch Robot, Inc., a Delaware C corporation ("Dispatch Robot," "we," "us," "our"). "Honk" is the name of our mobile application and related services.

2. What Honk does

Honk helps professional truck drivers import oversize-load permits, review extracted permit details and prescribed routes, and use turn-by-turn guidance. It also provides account management and permit scan purchases. Honk does not issue permits or replace the issuing authority, the original permit, or your own safety and compliance checks.

3. Your account

You must be 21 or older

Honk is only for adults pursuing or holding a commercial driver's license (CDL). By creating an account you confirm you are at least 21 years old.

Keep your info accurate

Provide truthful information at signup. Keep your login credentials safe. You are responsible for everything that happens under your account.

4. Use Honk for legal stuff

Don't use Honk to break the law, harass anyone, scrape data, reverse-engineer the app, transmit malware, or interfere with our service. We can suspend or terminate your account if you do.

5. Your data is yours

You own the permit documents, photos, profile content, and other content you put into Honk. You grant us a limited, non-exclusive, royalty-free, worldwide license to store, display, and process that content for the sole purpose of operating the service. The license terminates when you delete your account.

6. Permit processing

Honk uses third-party AI services to extract permit text, restrictions and routes. When you add a permit, its contents are processed by these providers as described in our Privacy Policy. Submit only documents you are entitled to use and share. Extraction can be incomplete or wrong; review the result against every page of the original permit before approving a route.

7. Your route and compliance responsibilities

The original permit and issuing authority control. Honk guidance does not authorize you to drive a route or carry a load.

You remain responsible for the permit's validity, vehicle and load dimensions, travel windows, escorts, clearances, closures, local restrictions, DOT and FMCSA requirements, and compliance with all applicable laws. Stop and review any discrepancy before continuing.

8. Navigation limitations

Maps, road conditions, location signals and guidance can be inaccurate, outdated or unavailable. Honk cannot guarantee clearances, access, traffic conditions or safe passage. Follow signs, lawful instructions and the original permit. Do not operate the app while driving or rely on it for emergency services.

9. Issuer information

Honk may retrieve a permit from the issuer or website linked by a QR code you scan. Honk is not affiliated with or endorsed by an issuing authority unless expressly stated. You are responsible for obtaining any required authorization to access and use a permit.

10. Subscriptions and payments

If you purchase permit scans or a subscription through Honk, billing is handled by the Apple App Store or Google Play. Their terms govern billing, refunds, renewals, and cancellations. You can manage and cancel subscriptions in your App Store or Play Store account settings. Deleting your Honk account does not cancel a store subscription; cancel it separately to stop renewal.

11. The service is provided "AS IS"

HONK IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

To the maximum extent permitted by law, Dispatch Robot disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free service. We do not warrant that permit extraction, routes, restrictions, navigation or other displayed information is accurate or complete.

12. Limitation of liability

Our total liability to you, for any and all claims arising out of or related to Honk, is capped at the greater of (a) one hundred U.S. dollars ($100), or (b) the total amount you paid Dispatch Robot in the twelve months immediately preceding the event giving rise to the claim.

Dispatch Robot is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost loads, missed shipments, regulatory penalties, or business interruption — even if we were advised of the possibility of such damages. Some jurisdictions do not allow these limits; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

13. You handle your own bad acts

You agree to defend, indemnify, and hold harmless Dispatch Robot, its officers, directors, employees, and affiliates from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of (a) your use of Honk, (b) your violation of these Terms, (c) your violation of any law, (d) your violation of another person's rights, or (e) any content you submit to Honk.

14. Disputes — binding arbitration

Read this section carefully. It affects your legal rights.

Any dispute, claim, or controversy between you and Dispatch Robot arising out of or relating to Honk or these Terms will be resolved exclusively by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, seated in Wilmington, Delaware. The arbitrator — not any court — has exclusive authority to resolve disputes about the formation, scope, or enforceability of this arbitration agreement.

Class action waiver

You and Dispatch Robot each waive the right to participate in a class action, collective action, or representative action. Disputes must be brought individually.

30-day opt-out

You can opt out of this arbitration agreement by emailing legal@honkchallenge.com within 30 days of first creating your Honk account, with the subject line "Arbitration Opt-Out" and including your account email or phone number. If you opt out, all other parts of these Terms still apply.

Small claims carve-out

Either party may bring an individual claim in small claims court if the claim qualifies.

15. Governing law and venue

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. For any matter not subject to arbitration, the exclusive venue is the state and federal courts located in New Castle County, Delaware.

16. Termination

You can terminate your account at any time by deleting it from within the app. We can terminate or suspend your account, with or without notice, if you breach these Terms or if we discontinue the service. A confirmed in-app deletion request disables account access and starts permanent deletion immediately. The app shows a completion confirmation after the backend finishes removing the account and its associated data. Deleted accounts cannot be recovered, subject to records we must retain by law. Cancel any store subscription separately. See our Privacy Policy for retention details.

17. Geographic scope

Honk is intended for users located in the United States. By using Honk from outside the U.S., you accept that U.S. law applies and that your information may be transferred to and processed in the United States.

18. Force majeure

We are not liable for failure or delay in performance caused by events outside our reasonable control, including natural disasters, war, terrorism, labor disputes, government actions, internet or carrier outages, or third-party platform failures.

19. Changes to these Terms

We may update these Terms at any time. If we make material changes, we will notify you in the app before the changes take effect and give you a chance to review them. Continued use of Honk after the effective date means you accept the updated Terms. If you don't agree, you can delete your account at any time.
